The petitioners herein were employed as teaching staffs in Kalaivanar N.S.K. Polytechnic College, Chenbagaramanputhu, Kanyakumari District. Their service details are as follows:- Sl.

Nothing was paid from July 2020 to December, 2020. Again, half salary was paid from January 2021 to September, 2022. From October, 2022, nothing was paid. It is in these circumstances, the petitioners herein filed 8/15

W.P.(MD)Nos.14140 to 14146 of 2023. They sought two fold reliefs. They wanted the college management to constitute the Grievance Redressal Committee as per AICTE Regulation. They also wanted disbursement of salary arrears and other monetary dues. Recording the undertaking of the college management that Grievance Redressal Committee would be constituted, the writ petitions were disposed of on 02.06.2023. Contending that the undertaking was not complied with, contempt petition came to be filed. Since five out of seven petitioners happen to be women and taking note of their grievances, this Court decided not to adopt a technical approach. Vide order dated 18.09.2024, it was directed that the college management shall pay a sum of Rs.10,00,000/- to each of the petitioners towards full and final settlement of their claims.

The management happens to be a trust. Therefore, sufficient time was given to enable them to raise funds and settle the petitioners' dues. Since the direction given by this Court was not complied with, this contempt petition was adjourned from time to time. Even though a very long rope was given to the college management, they had not come forward to settle the dues. In these circumstances, this petitioners have filed this sub application.

2.It is seen that the petition mentioned land is a vacant land and it is very much available. I permitted the college management to sell the same so that the sale proceeds, the petitioners' due can be settled. Even this offer was not availed by the college management. The lands in question are agricultural in character. The guideline value of the land is around Rs.2,00,000/- per cent. The dues payable to the petitioners is Rs.70,00,000/- and the extent of land is 35 cents. The guideline and market value may not always be the same.

3.The respondents 1, 3 and 4 are the authorities who are competent to represent the trust board. The said respondents are directed to execute sale deed conveying 28 cents of land in S.No.668/2 in favour of the petitioners herein so that each of the petitioners will have 1/7th undivided share. Upon presentation of such a sale deed, it shall be registered by the 29th respondent.
