PRAYER: Criminal Original Petition is filed under Section 482 of the Criminal Procedure Code, to direct the respondents 1 to 3 to provide adequate police protection to the petitioner and his family members to live peacefully in his house on the basis of the petitioner's representation dated 22.08.2017. O R D E R

This petition is filed to direct the respondents 1 to 3 to provide adequate Police Protection to the petitioner and his family members to live peacefully in his house, on the basis of the petitioner's representation dated 22.08.2017.

2. It is stated by the petitioner that the petitioner has purchased the property viz., residential house bearing Door No.74, Chithambarathanpatty, Manaparai Taluk, Trichy District, after paying the entire sale consideration. It is further stated that https://hcservices.ecourts.gov.in/hcservices/

the fourth respondent has promised to vacate the property, within a period of one month from the date of sale, but, now, he is refusing to hand over the possession. Hence, the petitioner has also given a complaint to the the respondents 1 to 3, since the respondents have not taken any action, the petitioner has approached this Court.

3. The petitioner himself admit that the fourth respondent has not vacated the premises which was purchased by the petitioner from the fourth respondent and hence, the petitioner seeks eviction of the fourth respondent through police. This Court does not find any merit in this petition to give a direction to the respondent Police.

4. Accordingly, the Criminal Petition is dismissed as devoid of merits. However, liberty is given to the petitioner to establish his right to seek recovery of possession from the fourth respondent in the manner known to law.
