ORDER

This writ petition has been filed challenging the order passed by the second respondent in Na.Ka.No.15/Forecast/ KTVL-PS/ 2025, dated 16.02.2025, with a consequential direction to the second respondent to grant permission and adequate police protection for conducting Kabadi Tournament from 22.02.2025 to 23.02.2025 at Vengalakurichi Taluk, Ramanathapuram District.

According to the petitioner, the petitioner is the player and organizer of the Kabbadi Club situated at Vengalakurichi Taluk, Ramanathapuram District and decided to conduct tournament scheduled to be conducted from 22.02.2025 to 23.02.2025. Therefore, the petitioner made a representation for grant of permission for conducting the aforesaid programme. However, the same was rejected by the second respondent vide the impugned order dated 2/6

16.02.2025. Kabadi tournament is only the sports activity. However, the second respondent simply rejected it on the ground that this sports event is conducted by particular community people and all the community people would participate in the said tournament and therefore, there may be chances for law and order issue. The second respondent cannot simply reject the request made by the petitioner for grant of permission for conducting kabadi tournament, citing law and order issue and hence, the order passed by the second respondent is liable to be set aside.

The learned Additional Public Prosecutor appearing for the respondents, would submit that the respondents rejected the request made by the petitioner for grant of permission for conducting kabadi tournament on the ground that there may be chances for communal clash and law and order issue. He would further state that the petitioner also sought for permission for conducting the kabadi tournament from 22.02.2025 to 23.02.2025, and therefore, the respondents rejected the request made by the petitioner by assigning valid reasons.

4. This Court had heard both sides and perused the materials available on record.

5. In this case, the sports event, namely, kabadi tournament is scheduled to be conducted from 22.02.2025 to 23.02.2025 but, the same was rejected by the respondents by citing law and order issue.

6. At this juncture, the learned Counsel appearing for the petitioner also assured that they won't create any law and order issue while conducting the sports event, namely, kabadi tournament and there will not be any communal related activities in the sports event.

Recording the submission made by the learned Counsel appearing for the petitioner and also considering the fact that the event is only the sports activity, this Court is inclined to set aside the order passed by the second respondent and accordingly, the impugned order passed by the second respondent, dated 16.02.2025 is set aside. The second respondent is directed to grant permission to conduct the sports event, namely, kabadi tournament by imposing appropriate conditions and time period. 4/6

8. With the above direction, this writ petition stands disposed of. There shall be no order as to costs.
