ORDER

This Civil Revision Petition has been filed challenging the order in I.A.No.1 of 2025 in unnumbered A.S.No...of 2025, dated 23.01.2026 on the file of the learned Principal District and Sessions Judge, Madurai. 1/4

2. Though the learned Judge observed that no valid reasons were provided by the petitioner for condonation of delay, that alone is not sufficient to dismiss the petition, particularly when the respondent remained ex parte. In the absence of any material demonstrating prejudice to the respondent if the delay were condoned, the dismissal of the condonation petition by the first appellate court cannot be considered fair.

3. In view of the above, this Civil Revision Petition is disposed of with liberty to the petitioner to file a fresh application before the first appellate Court. The first appellate court shall consider the same on merits within a period of one month from the date of receipt of a copy of this order. No costs.
