PRAYER: Criminal Original Petition filed under Section 482 of the Criminal Procedure Code, to direct the first respondent to transfer the investigation in Crime No.57 of 2011 pending on the file of the second respondent to the CBCID or any other investigation agency and file final report within the stipulated time. This petition has been filed to direct the first respondent to transfer the investigation in Crime No.57 of 2011 pending on the file of the second respondent to the CBCID or any other investigation agency and file final report within the stipulated time.

2.Today, when the matter is taken up for hearing, the learned Additional Public Prosecutor appearing for the State represented that the F.I.R, registered in Crime No.57 of 2011, after completing https://hcservices.ecourts.gov.in/hcservices/

the investigation, was closed as mistake of fact on 25.07.2011. 3.However, the learned counsel appearing for the petitioner would submit that he has not been called for any enquiry. 4.Recording the above said submission, the Criminal Original Petition is dismissed with liberty to the petitioner to file a private complainant after the receipt of RCS notice received from the respondent police. The respondent police is directed to serve RCS notice to the petitioner.
