ORDER

The Executive Officer/Joint Commissioner of the Arul Migu Meenakshi Sundaraeswara Thirukovil, Madurai has preferred this writ petition as against the order passed by the authority under the Payment of Gratuity Act dated 07.09.2021. 2.The third respondent with a grievance that gratuity amount due to him has not been paid has filed a claim petition before the second respondent and the same was allowed on 2/5

30.03.2017, against which, the petitioner has preferred an appeal before the first respondent. The first respondent by an order dated 07.09.2021, dismissed the appeal confirming the order passed by the second respondent. Aggrieved by the same, the petitioner has preferred the present writ petition. 3.The learned counsel appearing for the third respondent submits that the third respondent has already received the gratuity amount together with interest and therefore, nothing survives in this writ petition.

4.The learned counsel appearing for the petitioner submits that they have paid the gratuity amount to the third respondent. However, with regard to the interest portion, he seeks time to get instruction.

5.Since the beneficiary himself stated that he has received the gratuity amount together with interest, this writ petition is closed 3/5

as no further order is required. It is stated by the learned counsel on either side that the right of the gratuity for the temple employees is under consideration before the Hon'ble Supreme Court and the third respondent has also executed a bond undertaking to return the gratuity amount and the interest depending upon the outcome of the case. No costs.
