... Respondents Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Certiorarified Mandamus, calling for the records pertaining to the 4th respondent made in his proceedings in Ku.No. AEE/ D/ Town/ Usilai/ Ko.Service Relieving/ E.Ni.U /A.No. 023 /2026 dt.05.02.2026 and to quash the same as illegal and direct the 2nd Respondent to pass necessary orders by considering the petitioners representation dt.06.02.2026.
For Petitioner : Mr.S.Bala Karthick For Respondents : Mr.B.Ramanathan, Standing Counsel
ORDER
The petitioner, who is working as a Senior Driver at Usilampatti, has been promoted and posted as a Heavy Vehicle Driver at Pasumalai, Madurai, by the impugned order dated 05.02.2026. 2/5
2. Mr.B.Ramanathan, learned Standing Counsel, who takes notice for the respondents and submits that the petitioner, by the impugned order dated 05.02.2026, has been promoted as a Heavy Vehicle Driver and there is no scope for Heavy Vehicle Driver at Usilampatti and therefore, the petitioner has been posted at Pasumalai, which is around 30 kms. away from Usilampatti.
3. This Court considered the rival submissions made.
4. The only ground raised by the petitioner is that the order of promotion and relieving was issued by the 4th respondent all of a sudden without proper intimation. According to the petitioner, his father is aged about 89 years and his mother is aged about 75 years and therefore, he only has to take care of his parents and therefore, it would be difficult for him if he is posted at Pasumalai. On this ground, the impugned order cannot be interfered with. In the event, if the petitioner is not pressing for promotion, the case of the petitioner shall be considered by the respondents.
