For Respondents : Mr.R.Anandharaj, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in crime No.48 of 2017 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under Sections 457 and 380 of IPC, in Crime No.48 of 2017, on the file of the respondent police, seeks anticipatory bail.

2.Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the State. 3.The petitioner is shown as A-9 in a case of idol theft, registered on 04.05.2017. The contention of the petitioner is that out of nine accused all the other eight accused have already been granted bail and this petitioner has been wrongly roped in the case. Hence, he may be granted anticipatory bail.

CRL OP(MD). No.4007 of 2020 4.The learned Additional Public Prosecutor appearing for the State would submit that the case which was earlier registered in Crime No.48 of 2017 by the Sankarankovil Taluk Police Station has now been transferred to the Idol Wing Court for further investigation. Since this petitioner was absconding, the respondent police were not able to complete the investigation and file the final report. He would further submit that the petitioner is a party to the crime of idol theft. The confession statement of one of the accused by name, Balamurugan/A-1 recording on 08.06.2017, indicate the overt contribution of the petitioner herein in the crime.

Apart from this case, the petitioner is also involved in two more cases and therefore, if the anticipatory bail is granted to the petitioner, he may not properly co-operate with the investigation. 5.Considering the gravity of crime and long abscondance of the petitioner, this Court is of the view that granting of anticipatory bail will cause further delay of complete the investigation. 6.Accordingly, this Criminal Original Petition stands dismissed.
