For Respondent : Mr.K.Suyambulinga Bharathi, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in crime No. Not known of 2020 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petition for anticipatory bail has been filed apprehending arrest based on the complaint given by one Shyamala, for the alleged offences under Sections 294(b), 323 and 506(ii). 2.Whereas, the learned Government Advocate (Crl. side) would submit that one Shyamala has given a complaint against the petitioner herein alleging cheating and rape on false promise. Hence, the petition enquiry for the offences under Sections 417 and 376 is pending. The petitioner is not co-operating with the investigation and hence, the police is not able to proceed further with the complaint given by Shyamala.

3.The case of the petitioner herein is that he has advanced finance help to the complainant/Shyamala, when he asked back the money, the de-facto complainant lodged a false complaint. https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.3999 of 2020 4.In any event, unless and until, the petitioner co-operate with the investigation, the true fact will not come to light, hence, the anticipatory bail petition is disposed of with a direction to the petitioner to appear before the respondent police and co-operate with the enquiry. If any serious case is made out against the petitioner herein, it is open to the respondent to proceed in accordance with law.
