PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the first Respondent to preserve the CCTV footage of the second Respondent Police Station from 17.01.2024 to 18.01.2024 and provide a copy of the same to the Petitioner within a time frame stipulated by this Court based on the representation of the Petitioner dated 23.01.2024. O R D E R

The learned Counsel for the Petitioner submitted that the Petitioner had filed this petition seeking a Writ of Mandamus, directing the first Respondent to preserve the CCTV footage of the second Respondent Police Station from 17.01.2024 to 18.01.2024 and to provide the copies of the same to the Petitioner.

2.The learned Additional Public Prosecutor on instructions from the Respondent Police submitted that the CCTV Footage available in the place of residence of the Petitioner is safe. The Investigation Officer had handed over the same to the office of the Superintendent of Police, Kanniyakumari. If the learned Judicial Magistrate or the Trial Judge demands for CCTV Footage, the Respondents are ready to produce the same.

3.The Investigation Officer is directed to produce the part of the case dairy file, when the same is presented before the learned Judicial Magistrate as investigation final report.

4.With the above of said direction, this Writ Petition is disposed of. No costs.
