PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to direct the first respondent to direct the second respondent to hand over the investigation pertaining to Crime No.1388 of 2020 on the file of the second respondent, to any one of the independent agency such as CBCID or any other competent authority under the direct supervision of the first respondent.

ORDER

The petitioner has filed this Criminal Original Petition to direct the first and second respondents to hand over the investigation pertaining to the case in Crime No.1388 of 2020 on the file of the second respondent for the alleged offences under Sections 279 and 337 IPC to any one of the independent agency such as CBCID or any other competent authority under the direct supervision of the first respondent.

2. The case of the prosecution is that on 14.10.2020 the petitioner was coming near Valaiyankulam Junction with his two wheeler TN 28 AC 9732 while crossing a container lorry bearing Reg.No.TN 64 T 4197 was driven by his driver in a rash and negligent manner and suddenly dashed against the petitioner's vehicle. The petitioner was sustained injuries on his left and right leg and all over the body. Further he was immediately taken to Appollo Hospital and took treatment for his injuries. Hence, the petitioner gave a written complaint to the second respondent.

Today, when the matter was taken up for hearing, Mr.E.Antony Sahaya Prabahar, learned Additional Public Prosecutor appearing for the respondents, on instructions, would submit that the case in Crime No. 1388 of 2020 was ended in conviction by the judgment dated 07.03.2022 S.T.C.No.278 of 2022 on the file of the learned Judicial Magistrate, Thirumangalam with a total fine amount of Rs.1,500/- was paid on 07.03.2022.

4. In view of the above submission made by the learned Additional Public Prosecutor, no further adjudication in this petition.
