ORDER

This writ petition has been filed for issuance of Writ of Mandamus, forbearing the 4th respondent to grant permission to conduct the Maasi festival in Arulmigu Sri Angala Eswari Amman and Parivara Theivangal Temple situated at Alagapuri Palapatti Village, Vedasanthur Taluk, Dindigul District, to be held on 22.02.2023 and 23.03.2023 on the basis of the 2nd petitioner's complaint, dated 14.02.2023.

2.When the matter was taken up in the morning, there was no representation for the writ petition. The learned Additional Public Prosecutor is present and stated that the matter has become infructuous, since the temple festival is going to be over by today evening. On that ground, the matter was disposed of as infructuous. But, at about 1.30 p.m., the learned counsel for the petitioner appears before this Court and stated that the petitioners even though one of the Poojaries, another group namely the fourth respondent herein filed the writ petition in W.P.(MD).No.2884 of 2023, seeking a relief to consider the petitioner's representation dated 04.02.2023 and police protection for conducting Masi Festival from 2/5

22.02.2023 to 23.03.2023. That was also considered by this Court and direction was issued to consider the representation. 3.Now the learned Additional Public Prosecutor would submit that on the basis of the above said order only, the above said permission was granted. Now the festival is performed and going to be over by 05.00 P.M., Today.

4.At this juncture, the leaner counsel for the petitioner submitted that since the petitioners are also happened to be one of the poojaries, they may also be permitted to perform the pooja. Even though he filed the impleading petition before the Court unfortunately, it was not listed before this Court. What ever may be since the fourth respondent was granted permission, no order can be passed passed by this Court. The petitioner is at liberty to workout his remedy through appropriate proceedings. 5.With the above liberty, this writ petition is disposed of.
