PRAYER :- For Bail in Crime No. 999 of 2022 on the file of the respondent police.
ORDER : The Court made the following order :- The petitioner /accused who was arrested and remanded to judicial custody on 18.12.2022 for the offence under section 379 of IPC in Crime No.999 of 2022 on the file of the respondent police seeks bail.
2. The case of the prosecution is that on 17.12.2022 the petitioner herein committed theft of Rs.30,000/- from the defacto complainant while she was travelling in the bus from Kumbakonam to Nagapattinam, hence the case.
3. The learned counsel appearing for the petitioner would submit that a false case has been foisted against the petitioner and she is no way connected with the case. He would further submit since https://www.mhc.tn.gov.in/judis
there are many cases pending against the petitioner the respondent police has implicated the petitioner herein in this case. He would further submit that the petitioner is in custody from 18.12.2022, hence he seeks bail.
4. The learned Additional Public Prosecutor appearing for the respondent would submit that the petitioner is a habitual offender and against her 12 similar previous cases are pending. He would further submit that only some of the stolen properties have been recovered. He would further submit that the petitioner belongs to Andhra Pradesh, hence he objected to grant bail to the petitioner.
5. Heard. Perused the materials available on record including the First Information Report.
6. Taking into consideration of the facts and circumstances of the case and also taking into consideration the previous bad antecedents of the petitioner, this Court is not inclined to grant bail to the petitioner.
7. Hence the petition stands dismissed.
