ORDER : The Court Made the following order :- The petitioners, who are arrayed as accused Nos.1 to 4, apprehend arrest at the hands of the respondent police for the alleged offence punishable under Sections 294(b), 494 and 506(i) of I.P.C. in Crime No.5 of 2015 on the file of the respondent police and hence, seek anticipatory bail.

2. The case of the prosecution is that the husband of the de-facto complainant has married the fourth petitioner as second wife, when the earlier marriage was subsisting and thereby committed the offence under Section 494 I.P.C. and also threatened the de-facto complainant.

3. The learned counsel for the petitioners submitted that the marriage between the first petitioner and the de-facto complainant was solemnised on 16.03.2011 and within a short period, she left the matrimonial home and lodged a complaint against her husband and in-laws and the petitioners are facing cases before the Judicial Magistrate, Thirumayam. While so, a false complaint has been given on 02.03.2015.

4. Heard the learned Government Advocate (Crl.side) and perused the records.

5. Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioners, with certain conditions. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate, Thirumayam and on each of them executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned https://hcservices.ecourts.gov.in/hcservices/

and on further condition that the petitioners shall appear before the respondent police as and when required. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

6. The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
