PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents to take effective action to trace the petitioner's stolen two-wheeler motorcycle-Yamaha R15V3 bearing registration No.TN-60-AH-9808 engine No.G3N4E0146471 Chassis no. ME1RG6714M0090972 and restore the same to the petitioner by acting upon his complaint dated 30.01.2026 addressed to the 2nd respondent and representation dated 06.02.2026 to the 1st respondent without insisting on insurance papers within a reasonable period to be determined by this Court. 1/4

ORDER

The present writ petition is filed seeking a mandamus directing the respondents to take effective action to trace the petitioner's stolen two-wheeler motorcycle-Yamaha R15V3 bearing registration No.TN-60-AH-9808 engine No.G3N4E0146471 Chassis no. ME1RG6714M0090972 and restore the same to the petitioner by acting upon his complaint dated 30.01.2026 addressed to the 2nd respondent and representation dated 06.02.2026 to the 1st respondent without insisting on insurance papers.

2. The learned Government Advocate(crl.side) appearing for the respondents submits that the complaint was taken on file. After enquiry, the property was recovered. The said submission is recorded.

3. Now the petitioner is seeking permission of this Court to return of the property. The petitioner ought to follow the procedures. The petitioner is directed to approach the learned Judicial Magistrate, Melur, and file appropriate application. Once the application is filed, the same may be considered by the concerned Magistrate Court, within a period of one week from the date of filing of application.

4. With the above said directions, this writ petition stands disposed of. No costs.
