ORDER
This Criminal Original Petition has been filed to direct the learned III Additional District and Sessions Judge (PCR Court) at Madurai District, to consider and pass orders on bail application to be filed by the petitioners in connection with Crime No.43 of 2026 pending on the file of the second respondent on the same day..
2. Considering the nature of the relief sought for, notice to the 3rd respondent is dispensed with.
3. The case of the prosecution is that the first petitioner is the friend of the defacto complainant's second son, Vignesh, based on which, the first petitioner borrowed a sum of Rs.2,00,000/- from the 2/6
defacto complainant and thereafter, he failed to repay the said amount. When the same was questioned by the defacto complainant, the first petitioner asked the said Vignesh to come near PCM Nagar groundnut mill, pursuant to which, the said Vignesh and his friend Pandiyarajan went to the spot, at that time, the accused persons attacked them by referring caste name. Later, the defacto complainant's third son went in search of Vignesh, at that time, when the defacto complainant and her daughter, special child, were alone in their house, the accused persons trespassed into the defacto complainant's house and attacked the defacto complainant, subsequently, the defacto complainant returned back to home and the accused persons also attacked the defacto complainant's sons. Based on these allegations, an FIR has been registered against the petitioners.
4. Heard the learned counsel on either side and carefully perused the materials available on record.

Considering the limited scope of the relief sought for, this Court hereby direct the learned III Additional District and Sessions Judge (PCR Court) at Madurai District, to issue prior notice to the de facto complainant and thereafter to consider the bail application of the petitioners on the same day of their surrender before that Court in connection with Crime No.43 of 2026 on the file of the 2nd respondent police.
