ORDER : The Court Made the following order :- The petitioners apprehend arrest at the hands of the respondent police for the alleged offence punishable under Sections 498(A), 352, 294(b), 506(i) I.P.C, Section 4 of Tamilnadu Prohibition of Women Harassment Act and Section 4 of Dowry Prohibition Act in Crime No.6 of 2015 and hence, seek anticipatory bail.
2. The case of the prosecution is that the accused have demanded Rs.50,000/- and 5 sovereigns of jewels from the defacto complainant and harassed her.
3.The learned counsel for the petitioners submitted that the marriage between the first petitioner and the defacto complainant was solemnized on 10.02.2014 and the first petitioner/A1 has stammering, which was not liked by the defacto complainant and she she was insisting divorce from him. It is further submitted that the first accused wants only re-union and the earlier complaint given to the respondent was already enquired into and the same was closed as mistake of fact and this is the second complaint.
4. The learned Government Advocate(Crl.side) submitted that the accused are husband, mother-in-law and brother-in-law and they harassed the defacto complainant demanding dowry. https://hcservices.ecourts.gov.in/hcservices/ 5.Considering the facts and circumstances of the case, I am inclined to enlarge the petitioners on anticipatory bail.
Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate, Pattukottai, and on each of them executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the respondent police as and when required for interrogation. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.
6. The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready failing which, the petition for anticipatory bail stands dismissed.
