RESPONDENT/COMPLAINANT Criminal Miscellaneous Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to modify the condition imposed by this Honourable Court in Crl.O.P.(Md0.No.2161/2023 vide order dt 13.02.2024 by permitting the petitioner to appear as and when required for interrogation instead of appearing before the respondent police daily at 10.30.a.

Order : This Criminal Miscellaneous Petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.R.L.DHILIPANPANDIAN, Advocate for the petitioner and of MR.P.

This petition has been filed to modify the condition imposed by this Court in Crl.OP(MD)No.2161 of 2024 dated 13.02.2024 as 'as and when required for interrogation,' instead of 'appearing before the respondent police daily at 10.30 p.m for a period of two weeks and thereafter, as and when required for interrogation'.

2. The learned counsel for the petitioner would submit that the petitioners herein both are women and aged about 54 and 84 years. Hence, they are unable to comply with the condition. Hence, he seeks above said modification.

3. Considering the submission made by the learned counsel for the petitioner, this Court is inclined to modify the condition to the effect that the petitioners shall appear before the respondent Police as and when required for interrogation'. 4.Accordingly, this petition is allowed and time is extended for a period of two weeks.
