Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the respondents1 to 4, particularly the 1st respondent to dispose the petitioner's appeal/review petition dated 19.12.2024 before him. ORDER
Mrs.K.Malathi, learned Additional Government Pleader takes notice on behalf of the respondents 1 to 4.
2. Considering the limited relief sought for by the writ petitioner, with the consent of both the parties, writ petition itself is taken up for final disposal.
3. The grievance of the petitioner is that the patta in respect of the petitioner's property had been wrongly issued to the respondents 5 to 7. Hence, the petitioner has made an application to the District Revenue Officer for necessary correction in the patta and revenue records. 2/5
The application of the petitioner was rejected by the 2nd respondent after conducting an enquiry on 28.11.2024 and thereafter, the petitioner has preferred an appeal before the 1st respondent and the same is pending from 19.12.2024.
4. The petitioner has also relied upon the judgement and decree dated 04.03.1975 passed by the District Munsif, Pudukottai, in favour of the petitioner.
5. The main challenge to the rejection order passed by the 2nd respondent is non-consideration of the said judgement of the decree of competent Civil Court.
6. Be that as it may, the petitioner's appeal is admittedly pending with the 1st respondent since December 2024, it would suffice to direct the 1st respondent to dispose of the petitioner's appeal dated 19.12.2024. 3/5
7. In view of the above, this writ petition is allowed with a direction to the 1st respondent to dispose of the petitioner's appeal dated 19.12.2024 and pass orders in accordance with law within a period of 8 weeks from the date of receipt of a copy of this order.
