2.Even though notice has been served upon the third respondent, none appears on behalf of him.

3.The learned Government Advocate (Crl. Side) would submit that on the basis of the complaint received from the third respondent enquiry was undertaken. During the course of enquiry, both parties have given undertakings. Based upon the above said undertakings the complaint was closed.

4.Even though the counsel for the petitioner made objection with regard to the above said undertakings, nothing survives in view of the above said closure. The prayer sought for in this petition has become infructuous.

5.Accordingly, this criminal original petition is dismissed as infructuous.
