2. The petitioner is admittedly facing trial. The petitioner is given liberty to move the Judicial Magistrate No.III, Coimbatore in C.C.No.2 of 2023 for getting relief now sought for. If any such MP is filed, it shall be disposed of within a period of three weeks thereafter. The defacto complainant has to be heard before any order is passed. The first respondent will process the petitioner's application based on the order to be passed by the learned trial Magistrate.

3. With this liberty to the petitioner and the direction to the learned trial Magistrate, this writ petition stands disposed of. No costs. 27.02.2024 NCC : Yes / No Index : Yes / No Internet : Yes/ No PMU Note : Issue order copy on 29.02.2024.
