Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for an alleged offence punishable under Sections 403,409,466,468,471, 477(A) and 109 of IPC and 13(2) r/w. 13(1)(c) of Prevention Corruption Act, 1988 in Crime No.2 of 2015, seeks anticipatory bail.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) appearing for the respondent.

3. It is seen that this Court has passed the following order in Crl.O.P No.5034 of 2015 on 18.03.2015 in respect of the coaccused in this case:- " The learned Government Advocate (Crl. Side) submits that only a FIR has been registered and a detailed enquiry is going on and that the petitioners will not be arrested until the investigation is completed.

Recording the same, this petition is closed. However, this undertaking will not prevent the respondent police in issuing summons to the petitioners for the purpose of enquiry and the petitioners shall participate as and when called for"

4. In the light of the above, this petitioner is also on the same footing of the petitioners in Crl.O.P(MD).No.5034 of 2015. https://hcservices.ecourts.gov.in/hcservices/

5. Recording the submissions of the learned Government Advocate (Crl. Side) that the petitioner will not be arrested until the investigation is completed, this petition is closed. However, this undertaking will not prevent the respondent police in issuing summons to the petitioner for the purpose of enquiry and the petitioner shall participate as and when called for. sd/- 26/03/2015 / TRUE COPY / Sub-Assistant Registrar (C.S.)
