ORDER : The Court Made the following order :- The petitioner/ accused No.9 apprehends arrest at the hands of the respondent police for the offences punishable under Sections 147, 294(b), 332, 353, 506(i) of IPC, Section 4 of the Tamil Nadu Prohibition of Harassment of Woman Act, 2002, and Section 3(1) of the Tamil Nadu Public Property (Prvnt. Of Damage of Damage & Loss) Act, 1992 in Crime No.77 of 2018, on the file of the Inspector of Police, Nesamony Nagar Police Station, Nagercoil, Kanyakumari District, seeks anticipatory bail.

2.The petitioner is a practising Advocate. He has been shown as Accused No.9 in Crime No.77 of 2018. The specific stand of the petitioner is that he accompanied one Samraj, who was also been shown as Accused No.10 in the very same First Information Report. It appears that some quarrel took place in the office of the Returning Officer.

3.The learned Government Advocate (Crl Side) appearing for the respondent pointed out that the petitioner is having one previous case under Section 302 of I.P.C. and the case is pending trial.

4.Be that as it may taking note of the fact that the present First Information Report came to be registered in the background of Co-operative elections, this Anticipatory Bail is granted to two of the co-accused and bail to other accused, Anticipatory Bail is granted in favour of the petitioner. 5.Considering the facts and circumstances, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.II, Nagercoil, Kanyakumari District and on his executing a bond for a sum of Rs.

10,000/- (Rupees Ten Thousand only) with two sureties for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously. 6.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy is made ready, failing which, the petition for anticipatory bail shall stand dismissed.
