ORDER

The above Transfer Civil Miscellaneous petition has been filed by the wife seeking for transfer of H.M.O.P.No.259 of 2019 on the file of the learned III Additional Subordinate Judge, Madurai, to the Sub Court, Aruppukottai or any competent Court. 2.On the side of the petitioner, it is stated that the petitioner is having a seven months old baby and she is now residing with her parents at Kalkurichi, Aruppukottai taluk and that it is very difficult for her to attend the Court at Madurai and prays the case in H.M.O.P.No.259 of 2019 on the file of the learned III Additional Sub Judge, Madurai to be transferred to the file of the Sub Court, Aruppukottai.

3.Though the respondent was served with notice and his name was printed in the cause list, none appears for the respondent. 4.A perusal of the copy of the petition in H.M.O.P.No.259 of 2019 reveals that the wife is residing at Kalkurichi, Aruppukottai taluk. Hence, H.M.O.P.No.259 of 2019 is hereby withdrawn from the file of the III Additional Sub Court, Madurai, and is transferred to the Sub Court, Aruppukottai. The learned III Additional Sub Judge, Madurai, is directed to transmit the entire records in H.M.O.P.No.259 of 2019 to the Sub Court, Aruppukottai. The learned Sub Judge, Aruppukottai, is hereby directed to issue notice to the respondent, after the case is renumbered.
