Side) submits that it is a case and counter and both the parties have arrived at compromise. Further, he filed a status report filed by the the Inspector of Police, Mukkudal Police Station, Tirunelveli District identifying the defacto complainant and the accused Nos. 1 to 3 in both the Crl.O.Ps and the report shows that the compromise arrived at between the parties are bonafide.
2. Crl.O.P(MD).No.3058 of 2024 pertains to the quash of C.C.No. 444 of 2022 on the file of the Judicial Magistrate, Cheranmahadevi. Crl.O.P(MD).No.3059 of 2024 pertains to the quash of C.C.No. 374 of 2022 on the file of the Judicial Magistrate, Cheranmahadevi.
3. The defacto complainant in C.C.No.444 of 2022 in Crl.O.P(MD).No.3058 of 2024 is the wife of one Gunasekarn. The accused Nos. 1 to 3 in C.C.No.374 of 2022 in Crl.O.P(MD).No.3059 of 2024 are the sons of said Gunasekaran. The defaco complainant in C.C.No.374 of 2022 3/6
in Crl.O.P(MD).No.3059 of 2024 viz., Sukumaran, S/o. Arumugam, is the accused No.1 in C.C.No.444 of 2022 in Crl.O.P(MD).No.3058 of 2024 and the other accused Nos.2 and 3 in Crl.O.P(MD).No.3058 of 2024 are the son and wife of said Sukumaran respectively.
4. Considering the Joint Compromise Memos filed by both parties in both the Petitions independently, these Criminal Original Petitions are allowed and the C.C.Nos.444 and 374 of 2022 pending on the file of the Judicial Magistrate, Cheranmahadevi, are hereby quashed, in the light of the joint compromise memos. The Joint Compromise Memos shall part and parcel of the order. Consequently, the connected Miscellaneous Petition is closed.
