W.P(MD).No.5448 of 2021 Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorari, to call for the records relating to the Assessment Order TIN/33763445938/2017-18, dated 11.11.2020, passed by the respondent, quash the same as arbitrary and illegal.

For Petitioner : Mr.Joseph Prabakar For Respondent : Mr.M.Prakash Additional Government Pleader COMMON ORDER Heard the learned counsel for the petitioner and the learned Additional Government Pleader for the respondent.

2. The learned Additional Government Pleader for the respondent fairly submits that appropriate orders will be passed on merits and in accordance with law.

3. These two writ petitions are disposed of by quashing the impugned order and the case is remitted back to the respondent to pass a speaking order on merits and in accordance with law within a period of three months from the date of receipt of copy of this order, as the impugned order have been passed without hearing the petitioner. The petitioner is directed to co-operate with the respondent by filing replies/representations, if any. It is needless to state that before passing any such order, the petitioner shall be heard. No costs. Consequently, the connected Miscellaneous Petitions are closed.
