PRAYER: Writ Petitions filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus directing the respondent to pay the petitioner amount payable towards the encashment of 84 days of earned leaves, surrendered by her deceased husband / employee R. Ganapathy, Staff No.K2D990066 in the years before his death either based on his monthly wages of the respective months of surrender of those earned leaves, together with 18 percent interest per annum from the respective due dates or based on the monthly wages payable on the month of his death, together with 18 percent interest from the date of his death, within a time frame as may be fixed by this Court. 1/4

ORDER

The petitioner seeking encashment of 84 days of earned leave of her husband has submitted a representation to the respondent and has filed this writ petition.

2.The learned counsel for the petitioner submits that the petitioner's husband worked in the respondent transport corporation and he died on 20.09.2023 while he was in service. The respondent while settling the terminal benefits has not settled the benefits for surrendering 84 days of earned leave.

3.Considering the limited prayer sought for in this writ petition, the respondent is directed to pay the petitioner the eligible surrender leave salary along with 6% interest from the date which is payable till the date of realisation.
