PRAYER :- For Bail in Crime No.9 of 2016 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/ accused, who was arrested on 30.01.2021 for the offences punishable under Sections 294(b), 506(ii), 387 of IPC and Section 3(1) of TNPPDL Act in Crime No. 9 of 2016 on the file of the respondent police, seeks bail.

2. Heard the learned counsel for the petitioner and the learned Government Advocate(Crl.Side) appearing for the State.

3. When the matter is taken up for hearing the learned counsel for the petitioner submitted that the petitioner was regularly appearing before the trial Court on all hearing dates without fail and due to ill health of the petitioner he could not appear before the trial Court on 22.01.2020, hence Non Bailable Warrant was issued against him, pursuant to which he was arrested and remanded to judicial custody.

4. It is seen from the dismissal order passed by the learned Principal Sessions Judge, Kanyakumari that the petitioner is a history sheeted rowdy and having five previous cases against him out of which three cases are under Section 302 of IPC. Further he is absconding for more than one year. Hence this Court is not inclined to grant bail to the petitioner at this stage.
