ORDER : The Court Made the following order :- The petitioner, who is arrayed as A2 in Crime No.88 of 2015 on the file of the respondent police, was arrested on 10.03.2015 for the alleged offences punishable under Sections 120(b), 420 and 468 of I.P.C., and hence, seeks bail.
2.The case of the prosecution is that one Soundarajan lodged a complaint alleging that he is the owner of the property in Survey No.1405/3A at Muthuthevanpatti, Veerapandi Village, Theni District to an extent of 79 cents, but the accused have created a document of memorandum of understanding in the year 2009 claiming right over the property. 3.The learned counsel for the petitioner submitted that in respect of memorandum of understanding reached in the year 2009, a criminal case was registered in Crime No.47 of 2010 on the file of the Inspector of Police, District Crime Branch, Theni. He further submitted that the petitioner had obtained an anticipatory bail in Crl.O.P.(MD).No.9937 of 2010 on 23.09.2010 and after investigation, the police had laid a charge sheet and in that case, the petitioner is arrayed as A7. He further submitted that the property mentioned in this case is the subject matter of the earlier criminal case filed against the petitioner and the https://hcservices.ecourts.gov.in/hcservices/ petitioner is one of the victim in the memorandum of understanding.
4.Heard the learned Government Advocate (Crl.side) appearing for the respondent.
5.Considering the facts and circumstances of the case, this Court is inclined to grant bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Theni and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m until further orders.
