ORDER

This Sub Application has been filed to reopen the Contempt Petition (MD) No.720 of 2022, which was closed by the coordinate Bench of this Court, dated 08.09.2022, on the ground that the respondent had not complied with the directions issued by the Writ Court, dated 03.06.2021 passed in W.P(MD)No.8951 of 2021. 2.Today, when the matter is being taken up, Mr.D.Sadiq Raja, learned Additional Government Pleader for the respondent has produced an order, dated 14.06.2022 passed by the respondent and submits that the judgment and order passed by the Writ Court dated 03.06.2021 in W.P(MD)No.8951 of 2021 has been fully complied with and in this regard, a decision has already been given to the petitioner. Thus, he submits that there is no any further justification to reopen the Contempt Petition, as the judgment and order passed by the Writ Court dated 03.06.2021 has already been complied with. A copy of the decision, dated 14.06.2022 passed by the respondent was given to the learned Counsel for the petitioner today also. Thus, he submits that the present Sub Application may be dismissed. 2/4

3.Mr.M.Arun Srivastava, learned Counsel for the petitioner submits that as per the instructions of his client, the petitioner has not received any order, dated 14.06.2022 and for the first time, the order, dated 14.06.2022 has been served today in the Court and now only he came to know that the judgment and order passed by the Writ Court, dated 03.06.2021, has been complied with and he submits that he do not want to press this Sub Application and the petitioner may be given liberty to challenge the order, dated 14.06.2022 passed by the respondent before the competent Court of law.

4.Mr.D.Sadiq Raja, learned Additional Government Pleader for the respondent has no objection to the submission made by the learned Counsel for the petitioner. 5.After considering the arguments, as advanced by the learned Counsel for the parties and after perusal of the order dated 14.06.2022 passed by the respondent, this Court finds that there is no justification to reopen the Contempt Petition, as the judgment and order passed by the Writ Court dated 03.06.2021 in W.P(MD)No.8951 of 2021 has already been complied with by the Respondents. 3/4

6.Accordingly, the present Sub Application is dismissed with liberty to the petitioner to challenge the order dated 14.06.2022, passed by the Respondent, before the competent Court of law, if he so desires.
