FOR BAIL IN CRIME NO.503/2023 ON THE FILE OF THE RESPONDENT POLICE.

ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody for the alleged offence under Sections 25(1-A) of Arms Act, 1959 in Crime No.503 of 2023, 1/3

seeks bail.

2. The case of the prosecution is that on 25.12.2023 at about 9.00 a.m., when the defacto complainant along with the other Police personnel went on patrol duty near Pookkollai, the petitioner was found in possession of aruval in order to threaten the public and on seeing the Police party, he tried to flew away, he was rounded up and the weapon was seized by the respondent Police. Hence, the present complaint.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent and is no way connected with the alleged occurrence. He fairly submitted that 25 previous cases are pending against the petitioner, among which, most of the cases are false cases. Due to previous cases pending against the petitioner, the present false case has been foisted against him. He would further submit that the petitioner is in custody from 25.12.2023. Hence, he prays to grant bail to the petitioner.

The learned Additional Public Prosecutor would submit that apart from this case, twenty five previous cases are pending against the petitioner, among which, four cases are registered under Section 302 IPC, 4 cases are registered under Section 307 IPC, two cases are registered under Arms Act and also one NDPS cases. Hence, he vehemently opposed to grant bail to the petitioner.

5. Considering the facts and circumstance of this case and also considering the previous antecedents of the petitioner and there is no change in circumstances, this 2/3

Court is not inclined to grant bail to the petitioner.
