For Respondent : Mr.M.V.Chandrasekaran, Government Advocate (Criminal Side) PRAYER :- Petition for modification under Section 439(1)(b) rw/.Section 482 of Cr.P.C to modify the condition imposed by the learned Principal District and Sessions Judge, Ramnad in Crl. M. P No. 486/2021 dated 23.02.2021 in Crime No. 153/2020 on the file of the Respondent Police and relax the condition imposed by the learned Principal District and Sessions Judge, Ramnad. ORDER : The Court made the following order :- This petition has been filed to modify the condition imposed by the learned Principal District and Sessions Judge, Ramnad in Crl.M.P.No.486 of 2021 dated 23.02.2021.
2. The learned counsel for the petitioner would submit that the petitioner was granted anticipatory bail by the learned Principal District and Sessions Judge, Ramnad in Crl.M.P.No.1127 of 2020 dated 10.06.2020 with a condition to stay at Tiruvadanai and appear 1/3
before the Deputy Superintendent of Police daily at 10.00a.m., 5.00. pm., until further orders. Thereafter the petitioner had filed a petition for modification before the learned Principal District and Sessions Judge, Ramnad and the said Court vide order dated 03.07.2021 in Crl.M.P.No.1449 of 2020 had modified the condition and directed the petitioner to report before the Deputy Superintendent of Police, Thiruvadanai, fortnightly ie., on 1st and 15th every month at 10.00a.m., and 5.00 pm., until further orders and again the petitioner had filed a petition for modification before the learned Principal District and Sessions Judge, Ramnad and the Sessions Judge vide order dated 23.09.2020 in Crl.M.P.No.
2187 of 2020 had directed the petitioner to appear before the Deputy Superintendent of Police, Thiruvadanai on the first working day of every month at 10.00am., until further orders. He would further submit that the petitioner has been complying with the conditions for the past eight months and he is arrayed as A3. Further A1 and A2 in this case were granted bail the condition imposed on them was fully relaxed, in view of the same he seeks relaxation of the said condition.

Taking into consideration the submission made by the learned counsel for the petitioner, the order passed by the learned Principal District and Sessions Judge, Ramnad in Crl.M.P.No.486 of 2021 dated 23.02.2021 is modified and accordingly the earlier condition imposed on the petitioner in Crl.M.P.No. 2187 of 2020 dated 23.09.2020 directing him to appear before the Deputy Superintendent of Police, Thiruvadanai on the first working day of every month is totally relaxed.
4. This petition is ordered accordingly.
