Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, to direct the respondents to conduct the tender and auction as per the tender notification issued by the respondents dated 22.02.2020 and published on 23.02.2020 in daily news paper Dhinathanthi with number j P.gh.$.x.nt.vz; .221/2020 by following the procedure without violating the law.

ORDER

Mr.S.Bharanidharan, who is representing the learned counsel on record, states that a memo has been filed seeking to withdraw the writ petition. The memo signed by the petitioner as well as the learned counsel for the petitioner and the letter from the petitioner addressed to the learned counsel to withdraw the case have been produced before this Court. In the memo, it had been stated as follows:

'The petitioner does not want to pursue the above case nad wishes to withdraw the above case. A copy of the letter given and signed by the petitioner in this regard is enclosed herewith. This memo is filed to that effect.

W.P(MD)No.4571 of 2020 It is prayed that this Hon'ble Court may be pleased to record this memo and allow the petitioner to withdraw the case and thus render justice. ' 2.The learned Special Government Pleader, however, pointed out that in this case, this Court had directed the respondents to produce the sealed cover and that the result may not be declared. 3.The conduct of the petitioner in filing the writ petition and then, seeking withdrawal has to be condemned. Therefore, the respondent is also informed by this Court that, if any writ petition is filed by the present writ petitioner with respect to the present tender, the Court will certain take adverse notice on the conduct of the petitioner. The respondents are permitted to open the sealed cover, announce the result of the tender and proceed further in accordance law forthwith.

4.With the above observations, this Writ Petition is dismissed as withdrawn. No costs. Consequently, connected Miscellaneous Petition is closed.
