Heard the learned counsel appearing for the writ petitioner and the learned Government Advocate appearing for the official respondents.
2. The petitioner has included larger number of survey 2/5
3 W.P.(MD)NO.4246 OF 2026 numbers. It is admitted that survey Nos.4/4 and 9/5 alone are water bodies. The petitioner is therefore given liberty to pursue his remedy in respect of the other survey numbers by instituting fresh writ petition.
3. The fourth respondent is directed to issue notice to the private respondents and other encroachers if any, conduct survey and if the encroachments are noticed, then by adhering to due process of law, the encroachments shall be removed. The outcome of the survey will be properly intimated to the fifth respondent. The fifth respondent shall take action based on the outcome of the survey. The entire exercise will be completed within a period of five months from the date of receipt of a copy of this order. This writ petition stands disposed of. No costs.
