O R D E R

This Writ Petition is filed to quash the impugned Survey notice dated 09.02.2026 issued by the second respondent and consequently to direct the first respondent not to take any further steps in respect of the petitioner's land.

2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.

3. Initially, the petitioner herein had filed an application seeking survey, which was considered and the survey was conducted accordingly. The said survey was carried out pursuant to the order passed by this Court in W.P.(MD) Nos.20835 and 21298 of 2025, dated 05.08.2025. In paragraph No.13 of the said order, it has also been mentioned that the application submitted by the fifth respondent herein may be considered for conducting the survey.

4. The concerned authority failed to survey the land in respect of the fifth respondent herein. Aggrieved by the same, he approached this Court by way of filing contempt petition in Cont. P. (MD).No.3322 of 2025 and this Court vide order dated 03.02.2026 directed the contemnor to conduct a survey pursuant to the order passed in W.P.(MD).No.21298 of 2025.

5. Since the survey is to be conducted pursuant to the order of this Court, notice has been issued to the petitioner herein. The petitioner cannot object to the conduct of the survey, at the most, the petitioner may submit his objections.

6. With the above observations, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, the connected writ miscellaneous petition is closed. (K.SURENDER, J.) 12.02.2026 vsg Index: Yes/No Internet: Yes/No 4/6
