Heard the learned counsel on either side.

2.The learned counsel for the petitioner states that when he moved the Jurisdictional Magistrate, he dismissed his petition. The only remedy open to the petitioner is to file a petition either under Section 482 of Cr.P.C., or under Section 397 of Cr.P.C. A writ petition will not lie.

3.Therefore, leaving open the rights of the petitioner, this writ petition is dismissed. No costs.
