ORDER : The Court made the following order :- The petitioners/Accused, who apprehend arrest at the hands of the respondent for the offences punishable under Sections 465,471 and 420 of IPC in Crime No.693 of 2024 on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that the petitioner is working as collection agent in Shri ram Finance Limited, Thisayanvilai Branch, Tirunelveli District. On 20.08.2024 the Bank Manager verified the accounts of the petitioner and P.Bright Ponraj and found that they misused the deposited amount of several customers and collection amount totally Rs.14,56,000/- and Rs.5,70,000/-. In the mean time the defacto complainant also advised the petitioner to settle the entire amount but he has not done so. Hence, the case.

3. The learned counsel for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case. He would further submit that the petitioner is only a collection agent and the bank manager and the Division Manager misused the account . Hence, he prayed this Court to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) would submit that the ppetitioner is working as collection agent in Shri ram Finance Limited, Thisayanvilai Branch, Tirunelveli District. On 20.08.2024 the Bank Manager verified the accounts of the petitioner and P.Bright Ponraj and found that they misused the deposited amount of several customers and collection amount totally Rs.14,56,000/- and Rs.5,70,000/- Hence, he strongly opposed to grant anticipatory bail to the petitioners.

5. Heard both sides and perused the materials available on record.

Considering the rival submissions on either side and the nature of offences charged against the petitioner, the fact that no previous case is pending against the petitioner and also the fact that co-accused was released on bail and though the First Information Report has been registered in the year 2024 and so far the respondent police have not taken any steps to secure the accused and the material part of the investigation is almost over and the fact that the petitioner is only a collection agent, this Court is inclined to grant anticipatory bail to the petitioner, subject to the following conditions:

[a] Accordingly, the petitioner is ordered to be released on anticipatory bail on condition to execute bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the Judicial Magistrate, Radhapuram, Tirunelveli District , and on further conditions that: [b] the petitioner shall report before the respondent police every day at 10.00 a.m., until further orders.

[c] the petitioner shall not commit any offences of similar nature. [d] the petitioner shall not abscond either during investigation or trial. [e] the petitioner shall not tamper with evidence or witness either during investigation or trial.

[f] On breach of any of the aforesaid conditions, the learned Judicial Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner 4/6

released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560]. [g] If the accused thereafter abscond, a fresh FIR can be registered under Section 269 B.N.S.
