O R D E R
When this Court was about to dismiss the case on merits, the learned counsel for the petitioner sought permission of this Court to withdraw the Criminal Original Petition with liberty to the petitioner to raise all the points before the trial Court. However, the learned counsel prayed for dispensing with the personal appearance of the petitioner before the trial Court. He has also made an endorsement to that effect.
2. Accepting the submission and endorsement made by the learned counsel for the petitioner, this criminal original petition is dismissed as withdrawn with liberty to the petitioner to raise all the points before the trial Court after the charges are framed as there are prima facie materials to frame charges. The petitioner shall appear before the trial Court to receive the copies under Section 207 Cr.P.C., for framing charges, Section 313 Cr.P.C. questioning and on the date of judgment. For the other hearings, if the petitioner gives an undertaking that he will not dispute his identity and that his counsel will cross-examine the witnesses on the day they are examined in chief without adopting any dilatory https://hcservices.ecourts.gov.in/hcservices/
tactics, his petition under Section 317 Cr.P.C. may be liberally considered. If the petitioner adopts any dilatory tactics, it is open to the trial Court to insist upon his presence. The trial Court is directed to complete the trial within a period of six months from the date of receipt of a copy of this order. Consequently connected Miscellaneous Petitions are closed.
