For Respondent : Mr.K.Suyambulinga Bharathi, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory bail in Crime No.Not known of 2020 on the file of the Respondent police ORDER : The Court made the following order :- The petitioners apprehending arrest at the hands of the respondent police for the offences punishable under sections 498 (A), 294(b), 323 and 506 (ii) of I.P.C. and Section 4 of Tamil Nadu Woman Harassment Act.

2. It is a matrimonial dispute. The de facto complainant and the first petitioner have agreed to live together in the proceedings before the Family Court, Madurai, initiated by the respondent for restitution of conjugal rights. However, when the de facto complainant had gone to the house of the petitioners, she was not treated well and she was again harassed, demanded dowry and https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.4041 of 2020 physically assaulted. Hence, a complaint has been given by his wife against the petitioners on 01.03.2020. The second petitioner is the mother of first petitioner.

3. The first petitioner herein, who is working in CRPF has attended the enquiry once and thereafter, he has not participated in the enquiry, whereas, the learned counsel appearing for the petitioners would submit that the first petitioner received a message from the respondent Police that the parties have to work out their remedies before the Judicial Court. Hence, the first petitioner did not attend the enquiry.

4. The first petitioner, who is working in CRPF had made a false promise to take up the de facto complainant, but, when she went to her matrimonial home, she was brutally attacked, which laid to this complaint. Hence, this Court is not inclined to grant anticipatory bail to the petitioners. This Criminal Original Petition stands dismissed accordingly.
