For Respondent : Mr.K.Suyambulinga Bharathi, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- for Anticipatory bail in Crime No.49 of 2020 on the file of the respondent police.
ORDER : The Court made the following order :- The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under sections 447,294 (b), 324, 506(ii) of I.P.C and Section 4 of TNPHW Act seeks anticipatory bail.
2. The case of the prosecution is that due to water dispute for irrigation the petitioner and his wife went to the house of the defacto complainant armed with iron rod and has attacked the defacto complainant causing injuries. The defacto complainant was admitted in hospital on 08.02.2020 and got discharged only on 21.02.2020 after being an inpatient for 13 days.
3. The learned counsel for the petitioner would submit that the District Court has granted anticipatory bail to the second accused and investigation is almost completed. He would also submit that since the injured was discharged from hospital, the petitioner may be released on bail https://hcservices.ecourts.gov.in/hcservices/ 1/2

The learned Government Advocate(Crl.Side) would submit that the petitioner has caused hurt with iron rod and hence he is not entitled for anticipatory bail and the earlier petition was dismissed by this Court and there is no change in facts and circumstances of the case. Unless the petitioner is arrested and interrogated, it will be difficult for the respondent police to complete the investigation and file final report.
5. Taking note of the act of aggression and the injury caused to the defacto complainant ,this Court is not inclined to grant anticipatory bail to the petitioner.
