ORDER
The petitioner seeks for a direction to the 2nd respondent to withdraw the case in Crime No.171 of 2021 from the 2nd respondent and transfer the same to the first respondent.

The learned counsel for the petitioner submitted that the petitioner is the defacto complainant, on whose instance the FIR in Crime No.171 of 2021 was registered for the offences under Section 379 of IPC with respect to theft of 5 1⁄2 sovereign gold Thali, which was missing while she had visited Angala Parameshwari temple at Kodaiyur Village. However, there is no progress in the investigation and hence, this petition came to be filed.
3. The learned Government Advocate submitted that the alleged occurrence was of the year 2020, ie., 04.12.2020 and the FIR was registered on 15.04.2021 and the case was referred as 'undetected' and the same was also filed before the learned Judicial Magistrate, Aravakuruchi. Now, after lapse of five years, the petitioner came before this Court seeking the aforesaid relief.
4. Heard the learned counsel on either side and carefully perused the materials placed before this Court.

In view of the submission made by the learned Government Advocate that the FIR has been referred as undetected, on serving RCS notice to the defacto complainant, this criminal original petition stands disposed of by giving liberty to the petitioner to file a protest petition before the trial Court for further investigation.
