ORDER

This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing first respondent to dispose of the Appeal Proceedings in Na.Ka.P1/3304/2024, on the file of the first respondent, filed by the petitioner, within time frame as fixed by this Court.

2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.

3. Since no adverse orders are going to be passed against the fourth respondent, notice to the fourth respondent is hereby dispensed with.

4. The learned counsel for the petitioner submits that the petitioner is the absolute owner of the subject properties and is in peaceful possession and enjoyment thereof. However, the fourth respondent is alleged to have influenced the third respondent, who prepared a report behind the back of the petitioner

stating that the petitioner had encroached upon an excess extent of 51⁄4 cents of land on the eastern side of S.No.176/9 and had attempted to grab the cart track. Based on the said report of the third respondent, the second respondent, vide proceedings dated 23.03.2023, passed orders against the petitioner. Aggrieved by the proceedings of the second respondent dated 23.03.2023, the petitioner preferred an appeal before the first respondent. An enquiry notice dated 26.03.2025 was issued to the parties, directing them to appear before the first respondent on 01.04.2025. Thereafter, no further progress has been made in the appeal proceedings. Hence, the petitioner has been constrained to file the present Writ Petition seeking the relief stated supra..

5. The learned Additional Government Pleader appearing for the respondents 1 to 3 would submit that the petitioner's revision will be considered and appropriate orders will be passed on merits and in accordance with law within a time frame to be fixed by this Court.

6. Recording the above submission, and without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the first respondent to consider the petitioner's appeal, and pass appropriate orders on

merits and in accordance with law after providing reasonable opportunity of hearing to the petitioner, the fourth respondent and any other persons, who may be affected by such decision, within a period of sixteen weeks from the date of receipt of a copy of this order. There shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed.
