For Respondent : Mr.K.Suyambulinga Bharathi, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory bail in Crime No.189 of 2018 on the file of the Respondent Police ORDER : The Court made the following order :- This petition has been filed for anticipatory bail for the offence under sections 294(b), 326 and 506 (ii) of IPC for the occurrence that took place on 18.06.2018, in which the defacto complainant has lost his six tooth due to the assault by the petitioner.
2. Earlier the learned Principal Sessions Judge, Thanjavur has granted anticipatory bail to the petitioner on 21.06.2018, however the petitioner did not appear before the learned Magistrate and furnish sureties. Hence the anticipatory bail granted to him on 21.06.2019 got lapsed. In the meanwhile the petitioner had left India and taken job abroad. Now he has filed the present petition seeking anticipatory bail giving assurance that he will not abscond and ready to furnish sureties for his appearance.
3. Though the petitioner has given undertaking that he will not abscond and furnish sureties his previous conduct that even after granting anticipatory bail he did not furnish sureties and left the country.

4. Therefore this Court is of the view that petitioner will not ensure his presence and give due co-operation for trial.
