The present writ petition has been filed seeking to quash the tender notification issued by the first respondent primarily on the ground that it was issued as a physical tender and that the same ought to be cancelled and a fresh e-tender process to be initiated in accordance with the Tamil Nadu Transparency in Tenders Act, 1998.
2. The learned Additional Advocate General appearing for the first to third respondents submitted that the tender was not invited as a physical 2/5
tender, but only through the e-tender process in compliance with the provisions of the Tamil Nadu Transparency in Tenders Act, 1998. It was further submitted that the petitioner himself participated in the tender process, his technical bid has been opened, and the same is presently under evaluation.
3. In view of the categorical statement made by the learned Additional Advocate General, it is clear that the respondents have invited only an e-tender. Moreover, the petitioner, having participated in the said e-tender process, cannot now raise a grievance in this regard. In such circumstances, this Court finds no merits in the writ petition.
4. Accordingly, this writ petition stands dismissed. There shall be no order as to costs. Consequently, the connected miscellaneous petitions are closed.
