ORDER

The petitioner was initially appointed as a Staff Nurse on contract basis in the year 2011 and posted at Namakkal District. During the year 2016, she was transferred to the Government Primary Health Centre, Nettur, Tenkasi District. Thereafter, she was made as permanent and posted at the Government Thiruvarur Medical College Hospital. Subsequently, on her own request, she was deputed to the Government Hospital, Alangulam, Tenkasi Dsistrict, vide proceedings dated 23.08.2017. While so, the 1st respondent, vide his proceedings dated 16.06.2025, has cancelled the diversion order for 94 Staff Nurse including the petitioner. However, based on the petitioner's request, she was permitted to continue in the diverted institution until further orders, by proceedings dated 16.07.2025. Now, the petitioner has filed this writ petition seeking a direction to the 1st respondent to accommodate her in the available vacancy in the post of Staff nurse either in Tirunelveli 2/5

District or in Tenkasi District, based on her representation dated 15.12.2025.

The learned counsel appearing for the petitioner submits that the petitioner is a widow and she is having two children, studying in VI Std. and III Std. and she alone has to take care of her aged parents and mother-in-law. Therefore, she seeks for permanent transfer either at Tirunelveli District and Tenkasi District. According to the petitioner, the panel for promotion to the post of Superintendent was published on 09.12.2025 and following the promotion, more than 10 vacancies would arise in Tirunelveli and Tenkasi Districts. Therefore, the petitioner may be accommodated in the available vacancy either in Tirunelveli District or Tenkasi District.

3. Mr.G.V.Vairam Santhosh, learned Additional Government Pleader, takes notice for the respondents.

4. This Court is not inclined to entertain this writ petition in the light of the settled position that transfer and posting is an incidence of 3/5

government service and Courts cannot ordinarily interfere in the same. However, the representation of the petitioner shall be considered by the respondents and in the event that any vacancy arises in Tirunelveli or Tenkasi District, it is up to the respondents to take a call sympathetically and accommodate the petitioner in the available vacancy.
