For Respondent : Mr.K.Suyambulinga Bharathi, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory bail in Crime No.not Known in 2020 on the file of the Respondent Police ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Crl. Side) appearing for the respondent.

2. The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under sections 406, 420 and 506(ii) IPCin Crime No.Not Known of 2020 on the file of the respondent police, seeks anticipatory bail.

3.The learned counsel appearing for the petitioner would submit that the petitioner Mrs.K.Lavanya borrowed a sum of Rs.2,00,000/- from defacto complainant Mrs.Mariammal in the month of December 2017 and the said amount was settled long back. But the defacto complainant with an intention to grab more money, demanding further payment. Hence, warning criminal prosecution, legal notice dated 20.02.2020 issued by the petitioner, however, contrary to the truth, a complaint has been given by the defacto complainant as if the https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.4080 of 2020 petitioner has borrowed a sum of Rs.5,00,000/- and refused to repay the money. Further intimidating her with dire consequences, when she demanded re-payment.

4.The learned Government Advocate(Crl.side) would submit that based on the complaint given by the defacto complainant to the Deputy Superintendent of Police, Palani on 28.02.2020 forwarded for enquiry to the Inspector of Police, Palani Town, petition enquiry is pending in C.S.R.No.89 of 2020. If the petitioner participate in the enquiry, they will considered the documents produced by both the parties and take appropriate action.

5.Recording the same, this criminal original petition is disposed of directing the petitioner to participate in the enquiry and co-operate with the police.
