ORDER : The Court Made the following order :- The petitioners, who are A3 to A6, apprehend arrest at the hands of the respondent police, for the alleged offences punishable under Sections 420, 467, 468, 471, 477A IPC in Crime No.2 of 2015, on the file of the respondent police and hence, seek anticipatory bail.

2. The case of the prosecution is that the petitioners along with other accused jointly committed irregularities in the jewels pledged in the society.

3. The learned counsel appearing for the petitioner in Crl.O.P(MD) No.6403 of 2015/A3 submitted that the petitioner/A3 elected as President of the society only on 10.04.2013 and from the date of inception into the said office, the petitioner/A3 had came to know that the secretary and https://hcservices.ecourts.gov.in/hcservices/

other employees of the said society indulged in several malpractices and thereby causing loss to the society. Therefore, on many occasions, the petitioner/A3 bring the said facts to the higher official with a request to take appropriate action against them.

4. The learned counsels appearing for the petitioners in Crl.O.P(MD) Nos.6029, 6030 and 6420/A4 to A6 submitted that the petitioner/A4 to A6 are the members of the said society and they are innocents and they are falsely implicated in this case.

5. Heard the learned Government Advocate (crl.side) appearing for the respondents.

6. Considering the above said submissions, this Court is inclined to grant anticipatory bail to the petitioner in Crl.O.P(MD)No.6403 of 2015/A3 alone. Accordingly, the petitioner/A3 is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.III, Madurai and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner/A3 shall appear before the respondent police daily 10.00 a.m. until further order. Crl.O.P(MD) Nos.6029, 6030 and 6420 of 2015 filed by the other petitioners/A4 to A6, are dismissed. The petitioner/A3 shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.

7. The petitioner/A3 shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
