ORDER

The present contempt petition has been filed alleging violation of the order of this Court, dated 19.08.2024, made in W.P(MD)No.19839 of 2024. 2.A perusal of the order passed by this Court reveals that the petitioner has challenged a show cause notice issued by the second respondent on 23.07.2024, why a sum of Rs.5,94,962/- cannot be recovered from his DCRG. This Court has not entertained the writ petition and has directed the petitioner to file his objections. The second respondent was directed to consider his objection and pass orders on merits.

3.The petitioner has submitted his objections on 28.09.2024 and 25.11.2024. Without considering his objection, recovery has been made from the D.C.R.G. of the writ petitioner in October 2024. Thereafter, the petitioner has sent another representation on 25.11.2024. The second respondent has passed another order on 07.12.2024, and a subsequent order on 18.03.2025. 4.A perusal of the order passed by the second respondent on 28.10.2024, 07.12.2024 and 18.03.2025 reveal that the order of this Court, dated 19.08.2024, has not been complied with. Without considering the objection 2/4

raised by the writ petitioner, those orders have been passed by the respondent. When this was pointed out to the authorities, they have chosen to pass a fresh order on 04.04.2025, after referring to the orders of this Court and explanation submitted by the writ petitioner. Now it is the grievance of the writ petitioner that even in the order dated 04.04.2025, the explanation of the writ petitioner has not been properly considered.

5.Considering the above said facts, the order having been passed on 04.04.2025, the Contempt Petition stands closed with liberty to challenge the order dated 04.04.2025. In view of the fact that the order, dated 28.10.2024, 07.12.2024 and 18.03.2025, have been passed in violation of the order of this Court, these orders need not be challenged by the writ petitioner. 6.With the above said observations, this Contempt Petition stands closed. 07.04.2025 NCC : Yes/No Index : Yes/No Internet: Yes/No RJR To The Dean, Madurai Medical College, Madurai.
