ORDER

This petition has been filed by the petitioner to call for the records in F.I.R in Crime No.534 of 2024 on the file of the first respondent dated 28.12.2024 and quash the same.

2. The prosecution case is that due to a money dispute between the petitioner and the defacto complainant to the tune of Rs.19,00,000/-, the defacto complainant / second respondent herein lodged a complaint before the first respondent. Based on the said complaint, FIR has been registered in Crime No.534 of 2024 for the offence under Sections 316(2) and 318(2) of BNS, 2023 and the same is under investigation on the file of the first respondent. At this stage, the petitioner has filed this quash petition.

3. When the matter was taken up for hearing, the learned Counsels on both sides represented that the matter has been amicably settled between the parties and they have entered into a compromise and the same was filed before this Court.

4. This Court also enquired the petitioner as well as the defacto complainant, who are present in the Court and the defacto complainant has no objection to quash the F.I.R since he received a sum of Page no.2/4

Rs.19,00,000/- and thereby, they have entered into a compromise.

5. A compromise memo signed by the parties is filed before this Court and this Court also perused the terms of compromise entered into between the parties.

6. Considering the compromise entered into between the parties and the nature of offence, this criminal original petition stands allowed and the First Information Report in Crime No.534 of 2024, dated 28.12.2024 on the file of the first respondent police is quashed.
