ORDER
This Writ Petition is filed for issuance of a writ of Certiorarified Mandamus to call for the records relating to the impugned orders passed by the 3rd respondent in Na.Ka.No.05/VIPS/Proceedings/2026 dt. 05.02.2026, and quash the same as illegal and consequently direct the 3rd respondent to provide necessary police protection during the festival of Sri Sengidai Karuppar Sri Thundhumi Aathal Temple to be held from 23.02.2026 to 05.03.2026 between 6 p.m, 2/6
to 10 p.m.
2. Admittedly, the petitioner is a registered body which was registered in the year 2024. According to the prosecution there is a rival group. The petitioner is having 180 families and the rival group is having 55 families for which the fourth respondent is leading them. It is not known whether they have any registered body. But according to the petitioner they have administrative rights.
3. Since the prayer is limited to conducting the Masi Festival, this Court is inclined to allow the writ petition. Hence, the impugned order dated 05.02.2026 passed by the 3rd respondent is quashed. Further, the respondent police is directed to give necessary police protection to the petitioner during the time of Masi festival of Sri Sengidai Karuppar Sri Thundhumi Aathal Temple to be held from 23.02.2026 to 05.03.2026 between 6 p.m, to 10 p.m. 3/6
4. With these directions, this Writ Petition is allowed. No Costs.
5. In case, the fourth respondent and the 55 families are inclined to worship, they are at liberty to do the worship. It is made clear that only worshipping rights are granted to the 4th respondent and other 55 families. As far as the administrative rights is concerned, the petitioner is at liberty to do the administration. In case, the 4th respondent is seeking any administrative rights, he is at liberty to approach the competent civil Court.
